1. Acceptance of Terms

By creating an account or using Echelon (the "Service"), operated by Genesis Technology ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

Echelon is an AI-powered personal finance monitoring tool that connects to your bank accounts via Plaid to surface spending insights, detect anomalies, and send configurable alerts. The Service is for informational purposes only and does not constitute financial advice.

3. Eligibility

You must be at least 18 years old and a resident of the United States to use the Service. By using Echelon you represent that you meet these requirements.

4. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access at support@genesistechnology.io.

5. Financial Data and Plaid

Echelon uses Plaid to access your financial institution data with your explicit consent. You authorize us to retrieve your account balances and transaction history on your behalf. You may revoke this access at any time from the dashboard. We receive read-only access and do not initiate transfers or payments.

6. Subscriptions and Billing

Certain features require a paid subscription billed through Stripe. Subscriptions auto-renew unless cancelled before the renewal date. Refunds are handled on a case-by-case basis; contact us within 7 days of a charge for refund consideration. We reserve the right to change pricing with 30 days' notice.

7. Not Financial Advice

All insights, alerts, and analysis provided by Echelon are for informational purposes only. Nothing in the Service constitutes financial, investment, tax, or legal advice. Always consult a qualified professional before making financial decisions.

8. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorized access to our systems or other users' data.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Use automated tools to scrape or extract data from the Service.
• Share your account credentials with others.

9. Intellectual Property

All content, trademarks, and technology in the Service are owned by or licensed to Genesis Technology. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GENESIS TECHNOLOGY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason with reasonable notice. You may cancel your account at any time from your account settings. Upon termination, your right to use the Service ceases immediately.

13. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Georgia.

14. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email or in-app notice. Continued use after changes constitutes acceptance.
